Digital product and sales terms
These terms apply when you buy an Aegaea Digital product. Your order confirmation identifies the Aegaea entity supplying the product, the product specification, price and delivery target.
1. The contract and your authority
A contract is formed when Aegaea accepts your order after successful payment. You must provide accurate contact, site and boundary information and have authority to place the order for yourself or your organisation.
If you buy wholly or mainly outside your trade, business, craft or profession, you are a consumer. Provisions addressed to business customers apply only when you buy for business purposes.
2. Price, VAT and payment
The checkout price is the total shown for the selected product and includes VAT where the catalogue says it is VAT inclusive. Stripe processes card payment; Aegaea does not receive or store complete card details.
3. Inputs, scope and delivery
The product registry, order summary and product limitations form part of the contract. Delivery targets run from receipt of complete, usable inputs and are targets rather than guaranteed deadlines unless the order confirmation expressly says otherwise.
Automated products are generated from the identified data and engine versions without consultant review or sign-off. Assisted products include only the review stated in their specification.
4. Immediate supply and cancellation
If you ask Aegaea to begin digital supply during a statutory cancellation period, work may begin immediately. Where the law provides, your cancellation right may be lost once digital content has been supplied, or reduced to reflect services already performed. Checkout records your explicit request and acknowledgement separately.
Nothing in these terms removes cancellation, refund, repeat-performance or price-reduction rights that the law gives a consumer and does not permit the parties to exclude.
5. Checking the deliverable
Tell chris@aegaea.com promptly if a deliverable is inaccessible, materially incomplete against its stated specification or appears to contain a processing error. Aegaea may correct, repeat or replace the affected output where appropriate.
6. Use and important limitations
You may use the deliverable for the purpose stated in the product specification. It must be read with its source dates, confidence statements and limitations. You must not present an automated output as having consultant sign-off or use it as a substitute for a service that the product expressly excludes.
7. Liability
Nothing excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or a consumer's mandatory statutory rights.
For business customers, Aegaea is not liable for indirect or consequential loss, loss of profit, revenue, business, contracts, anticipated savings or data. Subject to liabilities that cannot lawfully be limited, Aegaea's aggregate liability arising from an order is limited to the amount paid for that order.
8. General
Aegaea may use subcontractors and third-party data providers while remaining responsible for its contractual obligations. If part of these terms is unenforceable, the rest continues. English law applies; a consumer may also rely on mandatory rights and courts available where they live.
